DashGraph Kullanım Koşulları

Bu Kullanım Koşulları, DashGraph: Excel to Dashboard uygulamasının iPadOS ve macOS sürümlerinin ("DashGraph" veya "Uygulama") kullanımını düzenler. Uygulamayı indirerek, satın alarak veya kullanarak bu koşulları kabul etmiş olursunuz.

1. Apple standart lisans koşulları

DashGraph App Store üzerinden lisanslanır; satılmaz. Apple'ın Standart Son Kullanıcı Lisans Sözleşmesi (EULA) Uygulamanın lisansına uygulanır. Bu Kullanım Koşulları, Apple Standart EULA'yı tamamlar. Aralarında çelişki olması hâlinde Apple'ın zorunlu koşulları ve yürürlükteki emredici hukuk kuralları önceliklidir.

2. Uygulamanın amacı

DashGraph, kullanıcının seçtiği Excel ve CSV dosyalarını cihaz üzerinde analiz ederek KPI kartları, grafikler, filtreler, tablolar ve dışa aktarılabilir dashboard çıktıları oluşturur.

Uygulamanın ürettiği analizler ve otomatik içgörüler genel bilgi ve karar desteği amacı taşır. Finansal, hukuki, vergi, muhasebe veya başka bir profesyonel tavsiye değildir. Önemli kararlar vermeden önce kaynak verileri ve sonuçları bağımsız olarak doğrulamanız gerekir.

3. Uygun kullanım ve kullanıcı sorumlulukları

Uygulamaya aktardığınız, işlediğiniz veya dışa aktardığınız veriler üzerinde gerekli haklara ve izinlere sahip olmanız gerekir. Uygulamayı:

• yürürlükteki mevzuatı veya üçüncü kişilerin haklarını ihlal edecek şekilde;
• yetkisiz erişim, kötü amaçlı kod, dolandırıcılık veya zararlı faaliyet amacıyla;
• kişilerin gizliliğini, fikri mülkiyetini veya ticari sırlarını ihlal edecek şekilde

kullanamazsınız.

Kaynak dosyaların yedeklerini korumak, analiz sonuçlarını kontrol etmek ve dışa aktarılan dosyaları güvenli biçimde saklamak veya paylaşmak sizin sorumluluğunuzdadır.

4. Free ve Pro özellikleri

DashGraph'ın bazı temel özellikleri ücretsiz sunulabilir. Daha büyük dosya sınırları, ek görseller ve KPI'lar, yerel Veri Asistanı, gelişmiş Excel seçenekleri, HTML/ZIP ve markalı yüksek çözünürlüklü PNG dışa aktarma gibi özellikler aktif bir DashGraph Pro aboneliği gerektirebilir.

Teknik dosya, bellek, çıktı ve platform sınırları ücretsiz veya Pro planlarda uygulanabilir. Pro aboneliği belirli bir dosyanın her koşulda açılacağını veya belirli bir analiz sonucunun üretileceğini garanti etmez.

5. Otomatik yenilenen abonelikler

DashGraph Pro, App Store üzerinden aylık ve yıllık otomatik yenilenen abonelik seçenekleriyle sunulur. Her iki plan da aynı Pro özelliklerine erişim sağlar; yalnızca faturalandırma dönemi ve App Store'da gösterilen fiyat farklıdır.

• Satın alma onaylandığında ücret Apple hesabınıza yansıtılır.
• Abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal edilmediği sürece seçilen dönem için otomatik olarak yenilenir.
• Yenileme ücreti, mevcut dönemin bitiminden önceki 24 saat içinde Apple hesabınıza yansıtılabilir.
• Geçerli süre ve fiyat satın alma ekranında App Store tarafından gösterilir. Vergiler ve para birimi ülkenize veya bölgenize göre değişebilir.
• Aboneliğinizi Apple hesabınızın abonelik ayarlarından yönetebilir veya iptal edebilirsiniz: https://apps.apple.com/account/subscriptions.
• Daha önce yaptığınız uygun satın alımları Uygulamadaki Satın Alımları Geri Yükle seçeneğiyle geri yükleyebilirsiniz.
• Faturalandırma, iptal ve uygun geri ödeme talepleri Apple tarafından kendi koşul ve politikalarına göre yönetilir. Gerekirse reportaproblem.apple.com üzerinden Apple'a başvurabilirsiniz.

Aboneliği iptal etmek, mevcut ücretli dönemin sonuna kadar olan erişiminizi genellikle sona erdirmez; erişim dönem sonunda ücretsiz plana döner. Uygulamanın silinmesi aboneliği otomatik olarak iptal etmez.

6. Dosyalar, çıktılar ve gizlilik

DashGraph seçtiğiniz dosyaları cihazınızda işler ve kaynak dosyaları değiştirmez. Uygulamanın oluşturduğu Excel, PNG, HTML ve ZIP çıktıları seçtiğiniz konuma kaydedilir.

Dışa aktarılan dosyalar çalışma verilerinizi içerebilir. Bir çıktıyı paylaşmadan önce içeriğini ve aktif filtre kapsamını kontrol etmeniz gerekir. Verilerin işlenmesine ilişkin ayrıntılar için DashGraph Gizlilik Politikası geçerlidir.

7. Fikri mülkiyet

DashGraph; yazılımı, tasarımı, markaları, metinleri ve Uygulamayla birlikte sağlanan örnek içerikleri dâhil olmak üzere Elluga'nın veya ilgili hak sahiplerinin fikri mülkiyetidir. Size yalnızca Apple Standart EULA ve bu koşullar kapsamında sınırlı, devredilemez bir kullanım lisansı verilir.

Kendi dosyalarınız ve Uygulama aracılığıyla oluşturduğunuz çıktılar üzerindeki haklarınız size ait olmaya devam eder. Uygulamayı kullanmanız, Elluga'ya çalışma dosyalarınız üzerinde mülkiyet hakkı vermez.

8. Üçüncü taraf hizmetleri

Uygulama; App Store, abonelik yönetimi, destek sitesi veya başka dış bağlantılara erişim sağlayabilir. Bu hizmetlerin kullanılabilirliği ve işleyişi ilgili üçüncü tarafların koşul ve politikalarına tabidir. Elluga, üçüncü taraf hizmetlerinin kesintisiz veya hatasız çalışacağını garanti etmez.

9. Güncellemeler ve kullanılabilirlik

Uygulamayı güvenlik, uyumluluk, performans veya özellik geliştirmeleri için güncelleyebiliriz. İşletim sistemi, App Store, üçüncü taraf dosya biçimleri veya teknik gereksinimlerdeki değişiklikler belirli özelliklerin değişmesine ya da kullanılamamasına yol açabilir.

Uygulamanın veya bir özelliğin sunumunu, yürürlükteki hukuk ve mevcut abonelik haklarına tabi olarak değiştirebilir, askıya alabilir veya sonlandırabiliriz.

10. Garanti reddi

Yürürlükteki hukukun izin verdiği en geniş ölçüde Uygulama "olduğu gibi" ve "mevcut olduğu şekliyle" sunulur. Uygulamanın kesintisiz, hatasız veya her veri setine uygun olacağı; belirli bir ticari sonuca yol açacağı ya da üretilen analizlerin tamamen doğru olacağı garanti edilmez.

Bu hüküm, tüketici olarak sahip olduğunuz ve sözleşmeyle kaldırılamayan yasal hakları sınırlandırmaz.

11. Sorumluluğun sınırlandırılması

Yürürlükteki hukukun izin verdiği ölçüde Elluga; Uygulamanın kullanımından veya kullanılamamasından kaynaklanan dolaylı, arızi, özel ya da sonuç niteliğindeki zararlardan; kâr, iş, veri veya fırsat kaybından sorumlu değildir.

Bu sınırlamalar kasıt, ağır kusur, bedensel zarar veya yürürlükteki hukuk uyarınca sınırlandırılamayan diğer sorumluluklar için geçerli değildir. Apple Standart EULA'daki uygulanabilir sorumluluk hükümleri saklıdır.

12. Fesih

Bu koşulları ihlal etmeniz hâlinde kullanım hakkınız Apple Standart EULA ve yürürlükteki hukuk çerçevesinde sona erebilir. Uygulamayı kullanmayı bırakarak ve cihazınızdan silerek kullanımı sonlandırabilirsiniz. Uygulamayı silmenin aktif bir aboneliği iptal etmediğini unutmayın.

13. Uygulanacak hukuk

Apple Standart EULA'nın ve tüketicinin yerleşim yerindeki emredici tüketici hükümlerinin uygulanması saklı kalmak üzere, bu koşullar Türkiye Cumhuriyeti hukukuna tabidir.

14. Koşullardaki değişiklikler

Bu koşulları Uygulama veya yasal gereksinimler değiştiğinde güncelleyebiliriz. Güncel sürüm bu sayfada yeni güncelleme tarihiyle yayımlanır. Yürürlükteki hukuk ayrıca onay gerektiriyorsa gerekli onay alınır.

These Terms of Use govern the iPadOS and macOS versions of DashGraph: Excel to Dashboard ("DashGraph" or the "App"). By downloading, purchasing, or using the App, you agree to these terms.

1. Apple Standard EULA

DashGraph is licensed, not sold, through the App Store. Apple's Standard Licensed Application End User License Agreement (EULA) applies to the App license. These Terms supplement the Apple Standard EULA. If they conflict, Apple's mandatory terms and applicable mandatory law control.

2. Purpose of the App

DashGraph analyzes Excel and CSV files selected by the user on the device and creates KPI cards, charts, filters, tables, and exportable dashboard outputs.

Analyses and automated insights produced by the App are for general information and decision support. They are not financial, legal, tax, accounting, or other professional advice. You must independently verify source data and results before making important decisions.

3. Acceptable use and your responsibilities

You must have all rights and permissions required for data you import, process, or export. You may not use the App:

• in violation of applicable law or third-party rights;
• for unauthorized access, malware, fraud, or harmful activity; or
• in a way that infringes privacy, intellectual property, or trade secrets.

You are responsible for maintaining backups of source files, reviewing analysis results, and securely storing or sharing exported files.

4. Free and Pro features

DashGraph may provide certain core features at no charge. Features such as higher file limits, additional visuals and KPIs, the local Data Assistant, advanced Excel options, HTML/ZIP export, and branded high-resolution PNG export may require an active DashGraph Pro subscription.

Technical file, memory, output, and platform limits may apply to Free and Pro plans. A Pro subscription does not guarantee that every file can be opened or that a particular analysis result can be produced in all circumstances.

5. Auto-renewable subscriptions

DashGraph Pro is offered through the App Store as monthly and yearly auto-renewable subscriptions. Both plans provide access to the same Pro features; only the billing period and price displayed by the App Store differ.

• Payment is charged to your Apple Account when the purchase is confirmed.
• The subscription automatically renews for the selected period unless canceled at least 24 hours before the end of the current period.
• Your Apple Account may be charged for renewal within 24 hours before the current period ends.
• The applicable duration and price are displayed by the App Store on the purchase screen. Taxes and currency may vary by country or region.
• You can manage or cancel your subscription in your Apple Account subscription settings: https://apps.apple.com/account/subscriptions.
• You can restore eligible previous purchases using Restore Purchases in the App.
• Apple manages billing, cancellation, and eligible refund requests under its own terms and policies. Where applicable, you can contact Apple at reportaproblem.apple.com.

Canceling a subscription generally does not end access before the current paid period expires; access returns to the Free plan at the end of that period. Deleting the App does not automatically cancel a subscription.

6. Files, exports, and privacy

DashGraph processes the files you select on your device and does not modify source files. Excel, PNG, HTML, and ZIP outputs created by the App are saved to a location you select.

Exports may contain your working data. You must review their contents and active filter scope before sharing them. The DashGraph Privacy Policy explains data handling in more detail.

7. Intellectual property

DashGraph, including its software, design, trademarks, text, and sample content supplied with the App, is the intellectual property of Elluga or the applicable rights holders. You receive only a limited, non-transferable license under the Apple Standard EULA and these Terms.

You retain your rights in your own files and outputs you create through the App. Using the App does not grant Elluga ownership of your working files.

8. Third-party services

The App may provide access to the App Store, subscription management, the support website, or other external links. Their availability and operation are governed by the relevant third party's terms and policies. Elluga does not guarantee that third-party services will remain uninterrupted or error-free.

9. Updates and availability

We may update the App for security, compatibility, performance, or feature improvements. Changes to operating systems, the App Store, third-party file formats, or technical requirements may cause features to change or become unavailable.

Subject to applicable law and existing subscription rights, we may modify, suspend, or discontinue the App or a feature.

10. Disclaimer of warranties

To the fullest extent permitted by applicable law, the App is provided "as is" and "as available." We do not warrant that the App will be uninterrupted, error-free, suitable for every data set, produce a particular business result, or generate completely accurate analyses.

Nothing in these Terms limits any statutory consumer rights that cannot be excluded by contract.

11. Limitation of liability

To the extent permitted by applicable law, Elluga is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, business, data, or opportunity, arising from use of or inability to use the App.

These limitations do not apply to intent, gross negligence, personal injury, or other liability that cannot be limited under applicable law. Any applicable liability provisions in the Apple Standard EULA remain in effect.

12. Termination

Your right to use the App may terminate under the Apple Standard EULA and applicable law if you breach these Terms. You may stop using the App by deleting it from your device. Remember that deleting the App does not cancel an active subscription.

13. Governing law

Subject to the Apple Standard EULA and mandatory consumer laws in your place of residence, these Terms are governed by the laws of the Republic of Türkiye.

14. Changes to these Terms

We may update these Terms when the App or legal requirements change. The current version will be published on this page with a revised update date. Where applicable law requires additional consent, we will obtain it.
